HATTIESBURG, Miss. (AP) - A Hattiesburg construction company has filed a motion asking Forrest County Circuit Court to confirm an arbitrator's decision and require the city of Hattiesburg to pay nearly $930,000 after it was found to be in breach of contract.
The Hattiesburg American reports (http://hatne.ws/V7g9Fc ) arbitrator Donald C. Dornan Jr. in late June awarded Precision Construction, LLC, over $843,000 for lost profit, unpaid change orders, extra mobilization, stored materials, retainage deposit return and prompt payment penalty.
Dornan, a Gulfport attorney who was appointed by Forrest County Circuit Court Judge Robert Helfrich to arbitrate the dispute, awarded another $83,000 in attorney's and other fees.
City Attorney Charles Lawrence said while the city technically agreed to the arbitration because of the contract clause, it intended to wait on the action of the Circuit Court.
