Summary judgment asked for in Hattiesburg dispute - Mississippi News Now


HATTIESBURG, Miss. (AP) - The civil complaint brought by two Hattiesburg city councilmen to compel Mayor Johnny DuPree to bring department head and municipal court nominees forward for confirmation likely will not make it into a courtroom until at least January.


Circuit Court Judge Robert Helfrich has recused himself from the suit.


Helfrich ordered the court clerk to send a copy of the recusal to the Mississippi Supreme Court, "requesting a special judge to hear the matter."


Helfrich had presided over a similar case in 2006, when councilmen filed a complaint against DuPree for declining to bring forward nominees.


The Hattiesburg American reports (http://hatne.ws/1zu6dq0) Robert Gholson, attorney for the councilmen, filed a motion Monday for summary judgment on behalf of his clients, citing precedent from the 2006-07 rulings.
